Terms of Service

Thank you for using Melissa! These Terms of Service ("Terms") govern your use of the Melissa website, web and mobile applications and AI assistant integration (MCP server) (the "Service"), operated by Ekaterina Fediukovich ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. These Terms contain a limitation of our liability.
1. Who can use Melissa
Melissa is a tool for mental health professionals — psychologists, psychotherapists, counsellors and similar specialists — who use it in the course of their professional activity. By using the Service, you confirm that you are at least 18 years old and act for purposes related to your profession, not as a consumer.
You must be a human. Accounts created by bots or other automated means are not permitted.
2. Your account
You are responsible for keeping your account secure, including access to the Google or email account you use to sign in, and for all activity under your account.
Tell us immediately at melissatreat.main@gmail.com if you suspect unauthorised access to your account.
3. Your professional responsibility
Melissa is an organisational tool. It is not a medical device, does not provide diagnoses or clinical recommendations and does not replace your professional judgement. You remain fully responsible for your clinical decisions and for complying with the professional, ethical and legal obligations that apply to you, including confidentiality and record-keeping rules.
AI features may produce inaccurate or incomplete results. Always check AI output before relying on it.
Melissa is not designed for emergencies.
4. Your data and your clients' data
Everything you enter into Melissa remains yours. You grant us a limited licence to store, process and display this content solely to provide the Service to you.
You are the data controller for your clients' personal data, and we are your data processor. You confirm that you have a lawful basis to record and process this data, including health data, that you inform your clients as required by law and that you record only the data necessary for your practice.
You can export your data at any time in Settings → Data and privacy.
5. Data processing terms
When the GDPR applies to client data you enter into Melissa, the following terms form our data processing agreement under Article 28 GDPR.
Subject and duration: storage and processing of client data for practice management, for as long as your account exists. Categories of data: identification data (name, birth year), appointment data, session notes and therapy goals, which may include health data, and payment records. Data subjects: your clients.
We process client data only on your documented instructions, which you give through your use of the Service and these Terms, unless EU or Spanish law requires otherwise. Anyone we authorise to access client data is bound by confidentiality.
We apply appropriate technical and organisational security measures, described in our Privacy Policy.
You give us general authorisation to engage the subprocessors listed in our Privacy Policy. We will notify you of new subprocessors in advance; if you object, you may close your account. We impose equivalent data protection obligations on our subprocessors.
Taking into account the nature of the processing, we will assist you in responding to requests from data subjects, in ensuring security, in handling personal data breaches and in carrying out data protection impact assessments. We will notify you without undue delay after becoming aware of a personal data breach affecting client data.
When you delete your account, we delete client data as described in our Privacy Policy, unless the law requires us to keep it.
On reasonable written request, no more than once a year, we will make available the information necessary to demonstrate compliance with Article 28 GDPR.
Client data is transferred outside the European Economic Area only with appropriate safeguards, such as an adequacy decision or Standard Contractual Clauses.
Connecting an AI app is your instruction to send the requested data to the AI provider you use with it. That provider is not our subprocessor and processes this data under your own agreement with it.
6. Plans, payment and cancellation
The Free plan costs nothing, does not require a payment card and is limited to 5 clients.
The Pro plan is a monthly subscription paid in advance through Stripe. Current prices are shown on our website and in the app; applicable taxes are shown at checkout. The subscription renews automatically every month until you cancel it.
You can cancel at any time in the app, in the billing section. Cancellation takes effect at the end of the current paid period: you keep Pro access until then and will not be charged again. We do not refund payments for the current or partially used period, except where required by law.
If a payment fails, we may limit access to Pro features until the payment is made. Your data is not deleted.
Promotional offers, such as free months of Pro for early users, apply on the conditions communicated with the offer.
We may change prices. We will notify existing subscribers by email at least 30 days in advance; the new price applies from the next billing period after this notice, and you can cancel before it takes effect.
7. Acceptable use
You may not: use Melissa for anything unlawful; store data you have no right to process; try to access other accounts or our systems without authorisation; interfere with or overload the Service; copy, resell or reverse-engineer the Service; or collect data from it by automated means other than the official AI assistant integration (MCP).
8. Third-party services
Melissa works with third-party services such as Google sign-in, Stripe, calendar apps and AI assistants such as ChatGPT or Claude. Their use is governed by their own terms, and we are not responsible for them.
9. Availability and changes to the Service
We work to keep Melissa available and secure, but we provide it "as is" and "as available" and do not guarantee that it will be uninterrupted or error-free.
We may change, add or remove features. If we remove a significant paid feature or discontinue the Service, we will notify you in advance and give you time to export your data.
10. Suspension and termination
You can stop using Melissa and delete your account at any time.
We may suspend or terminate your account if you seriously or repeatedly breach these Terms, if the law requires it or to protect the Service and other users. Except in urgent cases, we will notify you first and give you the opportunity to export your data.
11. Intellectual property
Melissa, its software, design and brand belong to us or our licensors. These Terms give you the right to use the Service, not ownership of it.
12. Liability
Nothing in these Terms limits liability that cannot be limited by law, including liability for wilful misconduct or gross negligence.
Otherwise, we are not liable for indirect or consequential damages, loss of profit, revenue or reputation, or for damage resulting from your clinical decisions, from content you enter, from third-party services or from unauthorised access caused by your failure to keep your account secure.
Our total liability under these Terms for any 12-month period is limited to the amount you paid us during that period, or €100 if you use the Free plan.
13. Changes to these Terms
We may update these Terms. We will notify you of significant changes by email or in the app at least 30 days before they take effect. If you do not agree, you can delete your account before then; by continuing to use the Service after that date, you accept the updated Terms.
14. Governing law
These Terms are governed by Spanish law. Disputes will be resolved by the courts of our domicile in Spain, unless mandatory law provides otherwise.
